RemoSharp Terms of Use

License Agreement

Thank you for your interest in RemoSharp! This License Agreement (the "Agreement") is made and entered into by and between the Author, Arastoo Khajehee ("Author"), and you, our valued user ("Licensee"), accessing or using the software known as RemoSharp (the "Software").

1. License Grant

We're thrilled to share RemoSharp with you! Subject to the terms and conditions of this Agreement, the Author happily grants you a non-exclusive, non-transferable license to use the Software, provided that the following conditions are met:

Attribution: Please keep the copyright notice, this list of conditions, and the following disclaimer with the Software. It's a small way to show appreciation for the work put into it.
Contributors: We appreciate every contribution! Contributors to the RemoSharp project will receive a free perpetual license delivered in written format as a token of our gratitude.
Donations: Donations to the project will be spent on current server costs, service expansion, and quality enhancement efforts. While we truly appriciate your kind donations, please note we cannot issue donation refunds under any circumstance.

2. Non-Commercial/Commercial Use

Enjoy using the Software for non-commercial purposes as much as you wish!
Commercial use of the Software is limited only to users with a paid active subscription plan. Expiration of the subscription plan or unsuccessful payments will result in the deactivation of the Licensee's account, thus services.
Trial accounts are limited to the stated trial period at the time of the activation on the website and at the check-out page, or less than 90 days; Expiration of either of these conditions results in the termination of the Licensee's trial period.

Trial Period: The Software is provided on a trial basis for a limited time.
The Author reserves the right to terminate the trial period at any time without prior notice.

The following requires written permission from the Author for both commercial and non-commercial use.

Selling or offering for sale the Software or any derivative works thereof.
Using the Software to provide paid services to third parties.
Using the Software in a commercial product or service.

3. Compliance with Open-Source Spirit

RemoSharp is open-source to foster community growth and inspiration. However, to protect the Author's interests and the significant effort invested in developing the Software, any copying, forking, or redistribution must be done with prior written agreement and consent from the Author.

4. No Copying or Redistribution

To protect the hard work put into RemoSharp, the Software may not be copied or redistributed without explicit written consent from the Author. This includes:

Copying the Software for distribution purposes.
Redistributing the Software, whether in original or modified form.
Sharing the Software with third parties.

5. Contributions and Compensation

We value your contributions and are open to compensate development contributions upon request. If the project or parts of it are monetized, we'll work together to reach a fair agreement based on the amount of contribution and compensation.

6. Disclaimer of Warranty

The Software is provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. The Author shall not be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from the use of the Software.

7. Limitation of Liability

In no event will the Author be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with this Agreement or the use of the Software.

8. Termination

The license granted under this Agreement will automatically terminate if the Licensee fails to comply with any of its terms. Upon termination, the Licensee must cease all use of the Software and destroy all copies in their possession or control.
The Author reserves the right to terminate the Software or any part thereof at any time without prior notice. In such case, the Licensee will be notified via email and the Software will be deactivated.
While notice about the termination of the Software will be sent to the Licensee, the Author is not liable for any damages or losses resulting from the termination of the Software.
The Author is not obligated to provide support or maintenance for the Software. However, the Author may provide support or maintenance at their discretion. The Author does not accept any obligation to provide support or maintenance or notice of termination of service, but may provide it at their discretion.
The Licensee may terminate this Agreement at any time by ceasing to use the Software and destroying all copies in their possession or control.
Please refer to the "Refund Policy" section on the website for information on refunds.
Temporary deactivation of the Software may occur due to server maintenance or updates. The Author will notify the Licensee of such deactivation via email. In such cases, the Licensee does not have the right to request a refund unless the deactivation is more than 5 days. In case of extented (more then 5 days) temporary deactivation, the Licensee is entitled to a refund for the remaining period of the service deactivation.

9. Refund Policy

General Policy

Refund requests must be made in writing to the RemoSharp support via email to [email protected] or [email protected].
Refund requests will be processed within 30 days of the refund request.
Refunds will be made to the original payment method and, if possible, in the same currency used for the purchase.
Please note RemoSharp and it's Author is not liable for any additinal costs, damages, or losses incurred by the user due to the use or termination of the Software and its services.
Refunds are available for any subscription plan or service purchased, provided the refund request is made within 24 hours of the payment.
Refund reqeusts will be processed regardless of the reason if the request is made within 24 hours of payment and within processed refund request attempt count.
Refund requests made after 24 hours of the payment will not be accepted.

Eligibility

Refunds can be requested a total of 5 times for a unique user.
Name, email, past payments, past payment methods, and other relavent information will be examined by the RemoSharp support to determine eligibility; for example, If a credit card is used across multiple accounts, refund attempts will count for all accounts using that card.
If the Software is incompatible with the Licensee's computer, the 24 hour limit may be extended to 7 days on a case by case basis and determined by the RemoSharp support.

Cancelation or Termination of the Software and Its Services

In the case of service termination due to permanent deactivation of the Software, and its servers, and services by RemoSharp's Author, the Licensee is entitled to a refund for the remaining period of the subscription plan or service only upon request within 30 days of the termination.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Author resides, without regard to its conflict of law principles.

12. Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements and understandings, whether written or oral, relating to such subject matter.

By accessing or using the Software, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement.
